Do you really buy this guy’s story? I’ve been going to Yanks game since I was 6. I’ve had a season ticket package the last 3 years. But I never took notice to peoples’ action during God Bless America until last night. There were people on the move all over the stadium…This guy’s probably another d-bag Boston fan looking to take another jab at the Yanks..

This story is bullshit. I was at the yankee game last night. Not only were people moving freely around the stadium, but during the moment of silence before “God Bless America” you could clearly hear a section singing “nah nah nah nah, hey hey hey, goodbye” as some sox fan was ejected for starting a fight.

Yankee Stadium is owned by the state and leased by the Yankees. The police are also provided by the city.

I hate to get all lawyer-y but there isn’t a constitutional issue unless there’s state action. The federal, state or municipal government has to be preventing you from speaking to implicate the constitution. If you’re on private property (e.g., Yankee Stadium) they can do whatever they want, if you don’t like it you can leave. The First Amendment doesn’t give you the right to say and do whatever you want, wherever you want. It keeps the government from telling what you can say and what you can’t.
